Terms and Conditions of Sale for LabotroniK

  1. General

These general terms and conditions of sale (the "Terms") apply to all sales of products and services (the "Products") by LabotroniK, a French company, to its customers (the "Customers"). By placing an order for Products, the Customer agrees to be bound by these Terms. These Terms may be amended from time to time by LabotroniK.

  1. Orders and Payment

2.1 Orders for Products may be placed through LabotroniK's website or by other means as agreed between the Customer and LabotroniK. 2.2 All payments for Products must be made in advance through PayPal.

  1. Delivery and Title

3.1 LabotroniK will use reasonable efforts to deliver the Products to the Customer in accordance with the delivery date agreed between the Customer and LabotroniK. 3.2 The title to the Products will pass to the Customer upon receipt of payment in full.

  1. Returns and Warranty

4.1 The Customer is responsible for the cost of returning any Products for repair or replacement under warranty. 4.2 LabotroniK warrants that the Products will be free from defects in material and workmanship for a period of two (2) years from the date of delivery (the "Warranty Period"). If a defect covered by this warranty occurs during the Warranty Period, LabotroniK will, at its option, repair or replace the defective Product. 4.3 The above warranty does not apply to any defect, damage or malfunction caused by misuse, abuse, accident, modification, or improper installation or operation of the Products.

  1. Limitation of Liability

5.1 LabotroniK's liability to the Customer in connection with any Product purchased through LabotroniK's website is strictly limited to the purchase price of that Product. 5.2 LabotroniK will not be liable to the Customer for any special, indirect or consequential loss or damage arising out of or in connection with the Products.

  1. Governing Law and Jurisdiction

These Terms and any disputes arising out of or in connection with these Terms shall be governed by and construed in accordance with the laws of France. The parties submit to the exclusive jurisdiction of the French courts.

  1. Entire Agreement

These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous agreements or understandings, whether oral or written.
